החלפות, החזרות וביטול עסקה
מדיניות זו חלה על החלפות, החזרות וביטול עסקאות שבוצעו באתר וב Show Room, בהתאם לתנאים המפורטים להלן ולהוראות הדין.
אין במדיניות זו כדי לגרוע מזכות המוקנית לצרכנית על פי חוק הגנת הצרכן או כל דין מחייב אחר.
החלפות של הזמנות מהאתר
במסגרת מדיניות ההחלפות של החברה, ניתן לבקש החלפת פריט בתוך 14 ימים ממועד קבלתו.
החלפה באמצעות שליח מטעם החברה כרוכה בעלות של 20 ₪.
ניתן לבצע החלפה גם ב Show Room ללא עלות משלוח.
לצורך החלפה במסגרת מדיניות החברה, הפריט צריך להיות במצב תקין, ללא שימוש, ללא כתמים, ללא ריח, ללא נזק שנגרם לאחר קבלתו ועם התוויות המקוריות מחוברות.
תנאים אלה מתייחסים למדיניות ההחלפה המסחרית של החברה ואינם גורעים מזכות ביטול או זכות אחרת המוקנית לצרכנית על פי דין.
ביטול עסקה והחזר כספי ברכישה באתר
עסקה שבוצעה באתר נחשבת עסקת מכר מרחוק וזכות הביטול שלה תחול בהתאם לחוק הגנת הצרכן ולהוראות הדין.
ככלל, ניתן למסור הודעת ביטול מיום ביצוע העסקה ועד 14 ימים ממועד קבלת המוצר או ממועד קבלת מסמך פרטי העסקה, לפי המאוחר מביניהם, ובכפוף לחריגים ולתנאים הקבועים בדין.
במקרה של ביטול עקב חרטה, שאינו נובע מפגם במוצר, אי התאמה, אי אספקה במועד או הפרה אחרת מצד החברה, החברה תהיה רשאית לגבות דמי ביטול בשיעור שלא יעלה על 5% ממחיר העסקה או 100 ₪, לפי הסכום הנמוך מביניהם, בהתאם להוראות הדין.
במקרה של ביטול עקב חרטה, האחריות והעלות הכרוכות בהחזרת המוצר לבית העסק יחולו על הלקוחה בהתאם לדין.
ניתן להחזיר את המוצר באופן עצמאי ל Show Room ללא עלות משלוח, או להזמין שליח החזרה מטעם החברה בעלות של 30 ₪.
ההחזר הכספי יבוצע בהתאם להוראות הדין ולא יאוחר מ 14 ימים ממועד קבלת הודעת הביטול.
החיוב יבוטל או יושב בהתאם לאמצעי התשלום ולהוראות הדין החלות על העסקה.
ביטול עקב פגם, אי התאמה או אי אספקה
במקרה של ביטול עסקה בשל פגם במוצר, אי התאמה בין המוצר שהוזמן לבין המוצר שהתקבל, אי אספקת המוצר במועד שנקבע או הפרה אחרת של העסקה מצד החברה, לא ייגבו דמי ביטול.
במקרה כזה, החזרת המוצר וההחזר הכספי יטופלו בהתאם להוראות הדין, והלקוחה לא תישא בעלות החזרת המוצר ככל שהדין מטיל על החברה את האחריות לכך.
תקופת ביטול מורחבת
צרכנית שהיא אזרחית ותיקה שמלאו לה 65 שנים, עולה חדשה או אדם עם מוגבלות, עשויה להיות זכאית לבטל עסקת מכר מרחוק בתוך תקופה של עד ארבעה חודשים, כאשר מתקיימים התנאים הקבועים בחוק, לרבות כאשר ההתקשרות בעסקה כללה שיחה בין העסק לבין הצרכנית.
החברה רשאית לבקש מסמך מתאים להוכחת הזכאות, ככל שהדבר מותר על פי דין.
קרדיט לאתר
במקום החזר כספי, ובמקרים שבהם קיימת זכאות להחזר כספי, ניתן לבחור מרצון בקבלת קרדיט לאתר בגובה הסכום ששולם עבור הפריטים המוחזרים.
בבחירה בקרדיט לאתר במסגרת מדיניות זו, החזרת הפריט באמצעות שירות המשלוחים של החברה תהיה ללא עלות.
תוקף הקרדיט יהיה שנתיים ממועד הנפקתו.
כאשר מדובר בשובר זיכוי שעליו חלות הוראות חוק הגנת הצרכן, יחולו עליו התנאים והזכויות הקבועים בדין, לרבות לעניין תקופת תוקפו ואפשרות מימושו.
הבחירה בקרדיט לאתר היא בחירה של הלקוחה ואינה גורעת מהזכות לקבל החזר כספי כאשר קיימת זכאות לכך על פי דין.
SALE, OUTLET ו FINAL SALE
רכישת מוצר במסגרת SALE, OUTLET או FINAL SALE אינה גורעת מזכות ביטול המוקנית לצרכנית על פי דין בעסקה שבוצעה באתר.
מעבר לזכויות הקבועות בדין, במסגרת מדיניות ההחלפות המסחרית של החברה, ניתן לבצע החלפה של פריטי SALE או OUTLET בתוך 5 ימים ממועד קבלת המוצר, בכפוף למצב המוצר ולזמינות המלאי.
פריטי FINAL SALE אינם ניתנים להחלפה במסגרת מדיניות ההחלפות המסחרית של החברה, אלא אם קיימת זכות אחרת על פי דין.
הלבשה תחתונה ובגדי ים ברכישה באתר
ברכישה שבוצעה באתר, זכויות הביטול בעסקת מכר מרחוק יחולו גם ביחס להלבשה תחתונה, חזיות ובגדי ים, בהתאם לתנאים ולחריגים הקבועים בדין.
אין בכך כדי לגרוע מזכויות החברה במקרה שבו נגרם למוצר נזק או חלה הרעה במצבו, ככל שקיימות לחברה זכויות בעניין זה על פי דין.
מצב המוצר המוחזר
במסגרת מדיניות ההחלפה והקרדיט המסחרית של החברה, יש להחזיר את הפריט במצב שבו התקבל, עם התוויות המקוריות, ללא שימוש, ללא כתמים, ללא ריח וללא נזק שנגרם לאחר קבלתו.
לעניין ביטול עסקה מכוח חוק, מצב המוצר והשימוש שנעשה בו ייבחנו בהתאם להוראות הדין, ואין בתנאי מדיניות ההחלפה המסחרית כדי לשלול זכות ביטול שהחוק מקנה לצרכנית.
החברה שומרת לעצמה את הזכויות העומדות לה על פי דין במקרה שבו נגרם למוצר נזק או חלה הרעה משמעותית במצבו.
רכישה פיזית ב Show Room
ברכישה שבוצעה פיזית ב Show Room יחולו הוראות הדין הרלוונטיות לרכישה בבית העסק, השונות בחלקן מהכללים החלים על רכישה באתר.
בכל הנוגע לביגוד והנעלה, כאשר מתקיימים התנאים הקבועים בדין, ניתן לבטל את העסקה עד תום יומיים ממועד הרכישה שאינם ימי מנוחה.
זכות זו כפופה לתנאים הקבועים בדין, לרבות מצב המוצר, מחירו והעובדה שתווית המחיר לא הוסרה, ככל שתנאים אלה חלים.
ברכישה פיזית בבית העסק, הלבשה תחתונה, לרבות בגדי ים, מוחרגת מזכות הביטול עקב חרטה בהתאם להוראות הדין.
האמור אינו חל על מקרה של מוצר פגום או זכות אחרת המוקנית לצרכנית על פי דין.
דרכי ביטול עסקה
כאשר קיימת זכות לבטל עסקה, ניתן למסור הודעת ביטול בדרכים הקבועות בחוק.

בנוסף, ניתן למסור בקשת ביטול באמצעות אמצעי הביטול המקוון המוצע באתר, וכן בכל דרך נוספת שבה החברה מחויבת לאפשר ביטול על פי דין.
לצורך טיפול יעיל בבקשה, מומלץ לציין שם מלא, מספר הזמנה ופרטי התקשרות.
החזרות בינלאומיות
במסגרת מדיניות החברה, ניתן לבקש החזרה של פריטים שנרכשו במחיר מלא בתוך 14 ימים ממועד קבלתם, בכפוף למצב המוצר ולהוראות הדין החלות.
פריטי SALE, OUTLET או FINAL SALE אינם ניתנים להחזרה במסגרת מדיניות ההחזרה המסחרית אלא אם צוין אחרת, או כאשר קיימת זכות החזרה או ביטול מכוח דין מחייב.
עלות משלוח ההחזרה מחו״ל תחול על הלקוחה, אלא אם ההחזרה נובעת ממוצר פגום, מוצר שגוי או נסיבות אחרות שבאחריות החברה בהתאם לדין החל.
החזרה באמצעות DHL Express עשויה להיות כרוכה בעלות של 25 דולר.
זכויות צרכניות מחייבות החלות במדינת מגורי הלקוחה או במדינת היעד יחולו ככל שהן חלות על העסקה ולא ניתן להתנות עליהן.

הוראות כלליות
מדיניות ההחלפות והקרדיט המסחרית של החברה נועדה להוסיף על הזכויות הקבועות בדין ואינה גורעת מהן.
בכל מקרה של סתירה בין מדיניות זו לבין הוראת דין מחייבת, תגבר הוראת הדין.
RETURNS, REFUNDS, EXCHANGES AND ORDER CANCELLATIONS
This policy applies to exchanges, returns and cancellations of purchases made through the website and at the Show Room, subject to the terms below and applicable law.
Nothing in this policy limits any mandatory consumer right granted under the Israeli Consumer Protection Law or any other applicable mandatory law.
Exchanges for Online Orders
Under the Company's voluntary exchange policy, an exchange may be requested within 14 days from the date the item is received.
Exchange using a courier arranged by the Company costs 20 ILS.
Exchanges may also be made at the Show Room without a shipping charge.
For an exchange under the Company's voluntary policy, the item must be in good condition, unused, free from stains, odors or damage caused after receipt, and with the original tags attached.
These conditions relate to the Company's voluntary exchange policy and do not limit any statutory cancellation or other consumer right.
Online Order Cancellations and Refunds
Purchases made through the website are distance sale transactions and may be cancelled in accordance with the Israeli Consumer Protection Law and other applicable laws.
As a general rule, a cancellation notice may be submitted from the date the transaction is made until 14 days after the product is received or the transaction disclosure document is received, whichever is later, subject to the conditions and exceptions provided by law.
Where cancellation is based on a change of mind and is not caused by a defect, nonconformity, failure to deliver on time or another breach by the Company, the Company may charge a cancellation fee of no more than 5% of the transaction price or 100 ILS, whichever amount is lower, in accordance with applicable law.
Where a cancellation is based on a change of mind, the customer is responsible for returning the product to the business as provided by law.
The product may be returned independently to the Show Room without a shipping charge, or through a courier arranged by the Company for 30 ILS.
Refunds will be processed as required by applicable law and no later than 14 days from the date the cancellation notice is received.
The transaction will be cancelled or the applicable payment refunded in accordance with the payment method and applicable law.
Defects, Nonconformity and Failure to Deliver
Where an order is cancelled because of a defective product, a discrepancy between the product ordered and the product received, failure to deliver on time or another breach by the Company, no cancellation fee will be charged.
The return and refund will be handled in accordance with applicable law, and the customer will not bear the cost of returning the product where the law places that responsibility on the Company.
Extended Cancellation Period
A customer who is a senior citizen aged 65 or older, a new immigrant or a person with a disability may be entitled to cancel a distance sale transaction within a period of up to four months, where the conditions required by law are met, including circumstances in which the transaction involved a conversation between the business and the customer.
The Company may request appropriate documentation confirming eligibility where permitted by law.
Store Credit
Instead of a monetary refund, and where a monetary refund is available, the customer may voluntarily choose to receive store credit for the amount paid for the returned items.
Where store credit is selected under this policy, return shipping using the Company's shipping service will be provided without charge .
Store credit will be valid for two years from the date it is issued.
Where a credit voucher is governed by the Israeli Consumer Protection Law, all statutory requirements will apply, including requirements concerning validity and the ability to redeem the credit.
Choosing store credit is voluntary and does not affect the customer's right to receive a monetary refund where such a right exists under applicable law.
SALE, OUTLET AND FINAL SALE
Purchasing a product as part of a SALE, OUTLET or FINAL SALE promotion does not eliminate any statutory cancellation right applicable to an online transaction.
In addition to statutory rights, under the Company's voluntary exchange policy, SALE and OUTLET items may be exchanged within 5 days from the date the product is received, subject to the condition of the product and stock availability.
FINAL SALE items are not eligible for exchange under the Company's voluntary exchange policy, unless another right applies under applicable law.
Underwear and Swimwear Purchased Online
For purchases made through the website, statutory distance sale cancellation rights apply to underwear, bras and swimwear in accordance with the conditions and exceptions provided by applicable law.
Nothing in this section limits any rights the Company may have under applicable law where a product has been damaged or its condition has deteriorated.
Condition of Returned Products
For exchanges and store credit offered under the Company's voluntary commercial policy, the item should be returned in the condition in which it was received, with the original tags, unused, free from stains, odors and damage caused after receipt.
Where a transaction is cancelled pursuant to a statutory right, the condition of the product and any use made of it will be considered in accordance with applicable law.
The conditions of the Company's voluntary exchange policy do not eliminate a statutory cancellation right.
The Company reserves any rights available under applicable law where a product has been damaged or its condition has materially deteriorated.
Purchases Made at the Show Room
Purchases made physically at the Show Room are subject to the legal provisions applicable to purchases made at a physical place of business, which differ in some respects from the rules applicable to online purchases.
For clothing and footwear, where the conditions required by law are met, the transaction may be cancelled until the end of two days following the date of purchase, excluding days of rest.
This right is subject to the conditions prescribed by law, including the condition of the product, its price and the price tag remaining attached, where applicable.
For purchases made physically at the business, underwear, including swimwear, is excluded from the statutory cancellation right based solely on a change of mind, in accordance with applicable law.
This does not affect rights relating to defective products or any other mandatory consumer right.

Where a statutory right to cancel exists, a cancellation notice may be submitted using the methods provided by applicable law.

Customers may also submit a cancellation request using the online cancellation method available on the website, together with any additional cancellation method the Company is required to provide under applicable law.
To help us process the request efficiently, customers are encouraged to provide their full name, order number and contact information.
International Returns
Under the Company's voluntary return policy, full priced items may be returned within 14 days from the date they are received, subject to the condition of the product and applicable law.
SALE, OUTLET and FINAL SALE items are not eligible for return under the Company's voluntary policy unless otherwise stated or where a mandatory right of cancellation or return applies.
International return shipping costs are the responsibility of the customer unless the return results from a defective item, an incorrect item or another circumstance for which the Company is responsible under applicable law.
Returns using DHL Express may be subject to a return shipping charge of 25 dollars.
Mandatory consumer rights applicable in the customer's country of residence or destination country will apply where they govern the transaction and cannot lawfully be excluded.
